{"id":2470,"date":"2011-10-12T07:00:00","date_gmt":"2011-10-12T15:00:00","guid":{"rendered":"http:\/\/www.formtek.com\/blog\/?p=2470"},"modified":"2011-10-12T07:00:00","modified_gmt":"2011-10-12T15:00:00","slug":"records-maanagement-email-no-longer-the-most-requested-for-ediscovery","status":"publish","type":"post","link":"https:\/\/formtek.com\/blog\/records-maanagement-email-no-longer-the-most-requested-for-ediscovery\/","title":{"rendered":"Records Maanagement: eMail No Longer the Most Requested Record Type for eDiscovery"},"content":{"rendered":"<p>As more enterprise data is being stored in content applications like SharePoint and Alfresco, and data from\u00a0Social Media applications are increasingly being requested for eDiscovery. \u00a0Symmantec <a title=\"Symmantec report on Records Management and eDiscovery\" href=\"http:\/\/www.marketwatch.com\/story\/symantec-survey-finds-emails-are-no-longer-the-most-commonly-specified-documents-in-ediscovery-requests-2011-09-19?reflink=MW_news_stmp\" target=\"_blank\">recently reported<\/a> that e-mail is no longer the most requested type of eDiscovery record requested. \u00a0The report follows closely on the heels of Symmantec&#8217;s <a title=\"Symmantec purchase of Clearwell\" href=\"http:\/\/www.clearwellsystems.com\/e-discovery-blog\/2011\/05\/19\/clearwell-signs-agreement-to-be-acquired-by-symantec\/\" target=\"_blank\">acquisition of Clearwell eDiscovery<\/a> this past May.<\/p>\n<div>The report looked at the distribution of record types now most frequently being requested in organizations for eDiscovery purposes:<\/div>\n<div>\n<ul>\n<li><strong>67 percent.<\/strong> Electronic Files and Documents<\/li>\n<li><strong>61 percent.<\/strong> Database and application data<\/li>\n<li><strong>58 percent.<\/strong> Emails<\/li>\n<li><strong>51 percent.<\/strong> SharePoint files<\/li>\n<li><strong>44 percent.<\/strong> Instant Messages and Text Messages<\/li>\n<li><strong>41 percent.<\/strong> Social Media<\/li>\n<\/ul>\n<\/div>\n<div>Symantec e-discovery attorney and former vice president at Clearwell\u00a0<a title=\"Symmantec Dean Gonsowski\" href=\"http:\/\/www.linkedin.com\/pub\/dean-gonsowski\/0\/69\/2a4\" target=\"_blank\">Dean Gonsowski<\/a>, said that &#8220;The fact that email is no longer the primary source of information for an eDiscovery request is a significant change from what has been the norm over the past several years,&#8221; said Dean Gonsowski, eDiscovery Counsel at Symantec. &#8220;With the wide variety of sources in play, including loose documents, structured data, SharePoint content and even social media, it is not enough for legal and IT to simply focus upon email alone. It&#8217;s critical for the two departments to work together to develop and implement an effective information retention policy.&#8221;<\/div>\n<div id=\"_mcePaste\">The Symmantec report recommendations some best practices:<\/div>\n<div id=\"_mcePaste\">\n<ul>\n<li>Define and implement Records Information (RIM) Policies for your organization<\/li>\n<li>Follow retention policies and delete data based on retention schedule (20 percent of organizations ignore their RIM policies and still retain everything.)<\/li>\n<li>Have separate backup and archive procedures. \u00a0Backup is for recovery. \u00a0Archiving is for Discovery. \u00a030-60 days is the longest that data should be backed up.<\/li>\n<li>Adopt Records Management software to manage legal holds. \u00a0Manual implementation of legal holds is too error prone.<\/li>\n<li>Conduct periodic audits and readiness exercises to validate that RIM practices are in place, ready and working.<\/li>\n<li>eDiscovery is moving past email reviews. \u00a0Expand your data managed to include social media, cloud data and instant messages.<\/li>\n<\/ul>\n<\/div>\n<div class=\"lightsocial_container\"><div
